INSTRUCTIONS: OHIO APPLICATION FOR FAMILY ALLOWANCE (Form 7.1)

The form discussed in this article is used by Ohio fiduciaries administering an estate to request family allowance in the event that there is a surviving spouse and no minor children who are not of the surviving spouse or if there is no surviving spouse and one minor child of the decedent. In such cases, the surviving spouse or minor child is entitled to $25,000 if the decedent died before March 1, 1999 or $40,000 if they died afterwards.
