INSTRUCTIONS: GA PETITION FOR ADULT NAME CHANGE—Fulton County

Use your current legal name in all places that call for “Petitioner.”  Leave the Civil Action File No. blank.  The clerk will fill out this part.

The rest of the Petition is straightforward.  Apart from the Petition, you’ll also be required to fill out a Verification form and Notice of Petition to Change Name form.

Make copies of all the forms.  Bring the originals and copies of the forms with you to the Clerk’s Office in Fulton County.  There are not statewide forms in Georgia, so these forms are specific to Fulton County.  You will have to pay filing fees, but if you cannot afford filing fees, you can file a Poverty Affidavit.

Unless the requirement is waived by the court, you need to publish notice once a week for at least four consecutive weeks in the Fulton County Daily Report.  After notice is published, the newspaper will mail you proof of the notice.

If 30 days have passed and notice has been published for four consecutive weeks, you can ask the court for a Decree of Name Change.  You’ll have to provide the following information for the Decree:

·  name

·  county of residence

·  date of birth

·  your new name

·  the reason you want to change your name

Ask the judge’s secretary you are at the court for a change of name.  A formal hearing is not required in Fulton County.  The judge will have you swear the truth within your forms and statements, and the judge will sign the Decree.

Return the Decree to the clerk and ask for a certified copy.  There is a small fee and additional fees for additional copies.

If you want to change your birth certificate, you need to provide a certified copy of the Decree to the Department of Vital Records.

INSTRUCTIONS: VERIFIED PETITION FOR CHANGE OF NAME OF MINOR PS-34282-5

 

Apart from the required questions and Petition, the following forms are also required:

· Appearance by Self-Represented Person in Civil Case TCM-TR3.1-6

· Affidavit of Diligent Search PS-34282-7

· Notice of Filing Proof of Publication PS-34282-8

· Notice of Hearing PS-34282-9

· Order on Verified Petition for Change of Name of Minor PS-34282-10

“Verified Petition for Change of Name of Minor PS-34282-5 Step 1”

Make sure to complete the heading of the form.  Then, provide the full legal name of the petitioner on the first line.  In part 1, circle if you are the father, mother, or guardian of the minor.  This petition is only valid if the other parent cannot be reached, and the Affidavit of Diligent Search proves the circumstances.

In part 3, provide the current legal name of the child.  On the next two lines, provide the child’s date of birth include month, date and year and the child’s mailing address.  If the child’s residential address is different from the mailing address, provide the address on the given lines.

I part 6, provide the driver’s license number of Indiana identification card number of the child.  Bring this form with you to the Change of Name Hearing.

In part 7, provide any previous names of the minor child.  In part 8, select what form of identification you will bring with you to the Change of Name Hearing to prove the minor is a US citizen.

In part 9, you need to prove the minor has never been convicted of a felony.  You cannot request a change of name if the minor has been convicted of a felony.

In part 14, state the proposed name of the child.  Sign the form in front of the Circuit Court Clerk.

Complete the rest of the forms, make copies, and bring the packet with you to the Clerk’s Office. The clerk will provide you with instructions about publishing Notice in a local newspaper.
