Form SB0014 Application Data Sheet

INSTRUCTIONS: APPLICATION DATA SHEET SB0014

“Application Data Sheet SB0014 Step 1”

Fill out the application information completely.  For the first field, use the information for the first inventor.  If there are more inventors, click the “Add” button at the bottom of the box.

Select the checkbox in the correspondence information to send correspondence to an address that is no associated with the specific customer number.  If there is correspondence, fill in the rest of the section.

In the application information, the title of the invention may be up to 500 characters long.  Application types include provisional, non-provisional, or a reissue.  The EFS-Web does not accept reissue applications.  The EFS-Web does not accept plant applications at this time either. Refer to page 5 of the guide in the link above for more information.

Check the “Customer” selection in the representative information if you want to assign a customer number for patent practitioners associated with the application.  Enter the customer number if it applies.  Check the “Patent Practitioner” option if you want to input practitioner name.  Regard pages 5 and 6 of the guide for more information.

If the application number is left blank in the “Domestic Benefit” section, the number will refer to the application being submitted.  For the filing date, select the date of the prior related application. You can add or delete domestic priority data.  For more information, regard page 6 of the guide.

For the application number in the “Foreign Priority Information,” enter the foreign document number of an associated foreign-filed application in the field.  For more information on this section, refer to pages 6 and 7 of the guide.

In the “Assignee” information, provide the first or given name of the assignee if the application is assigned to a group.  If the assignee only has one name, enter a period into one of the name fields.  Refer to page 7 of the guide for more information.

In the “Signature” Section, provide an electronic signature, the date the signature was provided, a printed name, and a registration number.

Form SB16 Provisional Cover Sheet

INSTRUCTIONS: PROVISIONAL APPLICATION FOR PATENT COVER SHEET SB16

 

The Patent and Trademark Office provide the following guide for this form: https://www.uspto.gov/ebc/portal/efs/sb16_inst.doc

“Provisional Application for Patent Cover Sheet SB16 Step 1”

Enter the following Inventor Information:

1. The inventor is the one who contributes to the conception of the invention (applicant must be the inventor)

2. Enter the first or given name of the inventor, enter a period if the inventor only has one name

3. Middle name is optional

4. Enter the last name or family name for the inventor

5. Enter the city of the inventor’s residence regardless if inventor is in U.S. or not

6. Enter the country code for the inventor’s country

7. If there are joint inventors, select the “Add” button for additional information

8. Enter the country code for the representative’s address

“Provisional Application for Patent Cover Sheet SB16 Step 2”

The title of the invention may have up to 500 approved characters.  Access the guide for information on approved characters.  If there is an attorney, the field is limited to 25 characters.

For the correspondence information, select the option to indicate where the correspondence should be directed.  Regard the guide for information on the customer number and information if you select “Firm or Individual Name.”

If the invention was made under an agency of the United States, provide the Government contact number.

In regards to the entity status, a small entity is an independent inventor, a small business concern, or a nonprofit organization that is eligible for reduced patent fees.

The signature is an electronic legal signature.  The person named needs to provide a signature, and the electronic signature needs to be in the /####/ format.  For more information, regard 37 CFR 1.4(d).

Enter the dates on which the submission is being signed.  Then, enter the first name and last name of the filer.  Enter a registration number if you are a patent practitioner.

Form SB0018 Design Patent Application Transmittal

INSTRUCTIONS: DESIGN PATENT APPLICATION TRANSMITTAL (SB0018)

 

This form is only used for new non-provisional applications under 37 CFR 1.53(b).  The form is approved for use through January 31, 2014. 

“Design Patent Application Transmittal SB0018 Step 1”

Provide all of the necessary information in the header of the document.  Do not leave any fields blank.

Make sure boxes 1 and 2 are checked.  Check the third box after you’ve gathered, completed, and attached all of the forms listed below:

·  Preamble

·  Cross References to Related Applications

·  Statement Regarding Fed sponsored R & D

·  Description of the figures in the drawings

·  Feature description

·  Claim

Check box 4 once you’ve attached drawings of the invention.  Provide the total amount of sheets as well.

Check box 5 once you’ve either provided a new or copied Oath of Declaration from a prior application.  If you a deleti9ng inventors from the original application, check i. and see 37 CFR 1.63(d)(2) and 1.33(b)

Check boxes 6 and 7 after the documents are completed and attached to this form.  Check the first box in step 8 if there is an assignee, and check the second box if there is a power of attorney.  Check box 9 if there is an English Translation Document provided.

Check box 10 once an Information Disclosure Statement is attached.  Check the second box if copies are needed from foreign patent documents, publications, or other information is needed.

Form SB0019 Plant Patent Application Transmittal

INSTRUCTIONS: PLANT PATENT APPLICATION TRANSMITTAL (SB0019)

 

This form is only for new non-provisional applications filed under 37 CFR 1.53(b).  The form is approved for use through January 31, 2014.

Fill out all of the necessary information in the header of the form.  Do not leave any information blank.

Make sure the boxes for steps 1 and 2 are checked.  Also, attach the necessary forms associated with the steps.

For step three, you need to provide the total number of pages for the following specification options:

· Descriptive title of the Invention

· Cross References to Related Applications

· Statement Regarding Fed Sponsored R & D

· Latin name of genus and species

· Variety denomination

· Brief Description of the Drawings

· Detailed Botanical Description

· A single claim

· Abstract of the Disclosure

For step 4, make sure you provide at least 2 copies if you have color drawings.  Provide the total amount of sheets as well.

In step 5, check the first box for an original or copy.  Check the second box if providing a copy form a prior application.  Check the third box or there is a deletion of inventors.

INSTRUCTIONS: REISSUE PATENT APPLICATION TRANSMITTAL SB0050

 

This form is approved for use through August 31, 2013.

In the header of the document, provide the attorney docket number, the first named inventor, the original patent number, the original issue date, and the express mail label number.  In the subheading, check the appropriate box for a utility patent, design patent, or a plant patent.

In steps 1 through 6, make sure all of the boxes are checked so you’re providing all of the necessary documents.  For step 3 and 4, the documents may be amended, and step 5 may be the original or a copy.

If you check “Yes” in step 7, check all of the applicable boxes listed below.  Check the first box if you provided a Written Consent of all Assignees (PTO/SB/53).  If you provided a 37 CFR 3.73(b) Statement (PTO/SB/96), check the second box.

If you’re using this form for a computer program, check step 8 indicating you provided a CD-ROM or CD-R duplicate.

This form is only used for non provisional applications under 37 CRF 1.52(b).  The form is also approved for use through January 31, 2014.

In the header of the form, fill in the attorney docket number if you’re using an attorney, the name of the first inventor if there is more than 1 inventor, the title, and the express mail label number.

In steps one through four, check all of the boxes that apply.  For steps three and four, provide the total amount of pages for each form.

Form SB0001a Declaration

INSTRUCTIONS: DECLARATION FOR UTILITY OR DESIGN APPLICATION USING AN APPLICATION DATA SHEET (SB0001a)

 

This form is approved for use through January 31, 2014.  The form is used as a declaratory statement stating the inventors understand all parts of the applications and that they are submitting the forms to the United States Patent and Trademark Office as defined under 37 CFR 1.56.  The form also declares that filers believe they are the first inventor(s) of the subject.

Type in the name of the invention within the heading of the document.

“Declaration for Utility or Design Application Using an Application Data Sheet SB0001a Step 2”

Check the first box if the declaration is being directed to the attached application.  Check the second box if the declaration is being directed to the United States application or the PCT international application number.  Provide the number if you checked box 2, as well as the date of filing. 

If the application was amended, check the third box and provide the date of amendment. 

“Declaration for Utility or Design Application Using an Application Data Sheet SB0001a Step 3”

Before signing the form, make sure to read the Warning Statement in full.  The last section of the statement states that the inventor(s) have completed all attached forms to the best of their ability and that all statements are true.  If the inventors willfully provide false statements, the act is punishable by fine or imprisonment.

If there are two inventors, provide the names of the inventors at the bottom of the document.  Provide signatures, the dates of the signatures, and where each inventor has citizenship.
