INSTRUCTIONS: TEXAS UNCONTESTED DIVORCE PROCESS WITH CHILDREN PACKET

You may represent yourself in a Texas divorce. This article discusses a packet of documents assembled by the organization Texas Law Help. These eleven forms are for the use of people in a divorce with children who are able to resolve all financial and childcare process and do not need a judge to rule on any such issues.

Texas Uncontested Divorce Process With Children Packet Step 1: The first document in this packet is an eight-page petition for divorce. This document must be served upon your spouse in order for the legal process to proceed.

Texas Uncontested Divorce Process With Children Packet Step 2: The second document is an out-of-state party affidavit only to be completed if the spouse you are filing against does not live in Texas.

Texas Uncontested Divorce Process With Children Packet Step 3: The next two forms are for the person who is responding to the complaint. The waiver of service will be filed if a spouse waives their right to be notified of future hearings. The answer form can be filled out to formally dispute or agree to negotiate with your spouse.

Texas Uncontested Divorce Process With Children Packet Step 4: The next document is a final decree of divorce that will be signed by a judge. You will be directed to complete this document under court supervision.

INSTRUCTIONS: INCOME/EXPENSE AFFIDAVIT (WILL COUNTY) (Form 8A/1, 2, 3)

In family court cases in Will County, Illinois concerning the dissolution of a marriage or disputes over alimony, child support or attorney's fees related to a divorce, both parties may be required to complete an Income/Expense Affidavit explaining their fiscal circumstances. This Form 8A/1, 2, 3 can be obtained from the website maintained by the Will County Circuit Clerk.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 1: At the top of the page, write the names of the plaintiff and defendant.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 2: Write your name on the first line underneath the words "Income/Expense Affidavit."

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 3: In line one, write how long you have been married and your age.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 4: In line two, write how many children you have and note their ages.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 5: In line three, indicate with a check mark whether or not you live in the marital home.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 6: In section four, provide all information requested about your expenses, including rent, utilities, child care costs and minimum credit card payments. Total your expenses where indicated.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 7: In section five, enter your gross income and federal tax refund from last year.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 8: In section six, provide all information requested about your current place of employment.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 9: In section seven, list all assets including real estate, motor vehicles, bank accounts and employment benefits. Include the current fair market value and debt owed on all of these.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 10: In section eight, list all liabilities, including mortgages, car loans, unpaid medical expenses, student loans and credit card accounts. Include the balance due and the amount you have paid for each one.

Income/Expense Affidavit (Will County) 8A/1, 2, 3 Step 11: Sign and date the bottom of the second page.
