INSTRUCTIONS: SOUTH DAKOTA COMPLAINT WITHOUT MINOR CHILDREN (Form UJS 310)

To initiate a divorce against your spouse in South Dakota in a marriage that does not involve children, you may file form UJS 310. Available on the website of the South Dakota Unified Judicial System, this form can be completed and filed without an attorney.

South Dakota Complaint Without Minor Children UJS 310 Step 1: Enter the circuit court number and county name of the court in which you are appearing, along with you and your spouse's name next to "Plaintiff" and "Defendant" respectively.

South Dakota Complaint Without Minor Children UJS 310 Step 2: In section one, enter the county and state in which you currently reside.

South Dakota Complaint Without Minor Children UJS 310 Step 3: In section two, enter the county and state in which your spouse currently lives.

South Dakota Complaint Without Minor Children UJS 310 Step 4: In section three, enter the date and location at which you were married. If you are no longer living together, give the date on which you physically separated.

South Dakota Complaint Without Minor Children UJS 310 Step 5: You do not need to complete section four unless your grounds for divorce include one of the six listed reasons, which should be indicated with a checkmark. Otherwise, your divorce will be processed on the grounds of irreconcilable differences.

South Dakota Complaint Without Minor Children UJS 310 Step 6: In section seven, note whether you plan to request spousal support.

South Dakota Complaint Without Minor Children UJS 310 Step 7: In section three under "Wherefore the plaintiff prays for judgment as follows," list if you wish for you or your spouse's former name to be restored. If this is the case, give their date of birth.

    You may obtain this form at the court or at the Bureau of Vital Statistics. You must use an original form (printed on archival-quality, acid-free paper). You may not use a photocopy.

NOTE: In most courts parents with children will not be granted a hearing on a petition for dissolution until both parents have viewed the 48 minute video, Listen to the Children. The video is about what children feel when their parents divorce and what parents can do to make the divorce less painful for their children. After viewing the video, you will be given a Certificate of Completion. Some courts require that both parents file their certificates of completion at the clerk’s office at the same time they file their petition for dissolution. In those courts, this means that you must see the video BEFORE you file your dissolution packet with the court. Check with your local court to understand whether the video is required and when you need to file the certificate of completion. Please see our  for information about your local court.

Form O.C.G.A § 19-6-15 Domestic Relations Financial Affidavit

 

INSTRUCTIONS: GEORGIA DOMESTIC RELATIONS FINANCIAL AFFIDAVIT (Form § 19-6-15)

Any Georgia resident filing a family court case concerning child support, alimony, division of property in a separation or related attorneys' fees will need to file a Domestic Relations Financial Affidavit along with the appropriate petition. The document must be served upon the other party before the case will proceed. You may complete the form, which can be obtained from the website of the Georgia Courts system, at any time. However, you must sign it in the presence of a district clerk or notary public.

Georgia Domestic Relations Financial Affidavit 19-6-15 Step 1: Enter the name of the plaintiff and defendant where indicated on page one, as well as the county where the case is being heard.

Georgia Domestic Relations Financial Affidavit 19-6-15 Step 2: In section one, enter your name and that of your spouse, as well as the date of your marriage and separation. List the names and birthdates of all children and which spouse they live with.

Georgia Domestic Relations Financial Affidavit 19-6-15 Step 3: Skip to section three. Follow the instructions to determine your gross monthly income. Transfer this figure from line 3a to line 2a. Deduct federal, state and FICA taxes withheld from wages to determine your net monthly income. Transfer this figure from 3c to 2b. Alternately, you may complete and attach Child Support Schedule A.

Georgia Domestic Relations Financial Affidavit 19-6-15 Step 4: In section four, list all assets and whether they are jointly or separately owned. Explain your basis for any claim that an asset is non-marital.

Georgia Domestic Relations Financial Affidavit 19-6-15 Step 5: In section 5a, follow the instructions to determine your total expenses. Transfer this number to 2c. In section 5b, note all payments to editors. Add these to the number from 5a in line 5c, and transfer this number to line 2c.

Georgia Domestic Relations Financial Affidavit 19-6-15 Step 6: Your spouse must be served with a copy of this affidavit prior to any courtroom hearing.
