INSTRUCTIONS: PETITION FOR OKLAHOMA COUNTY
There is no statewide petition for guardianship of a minor in Oklahoma. Apart from the petition, the petitioner will also have to file other forms with the District Court in Oklahoma County. These forms are located at the following link: https://www.oklahomacounty.org/courtclerk/Forms.htm
“Petition for Oklahoma County Step 1”
Provide the full legal name of the minor in the heading of the document. The Court Clerk will provide the case number. In the line above the first line, provide the full legal name of the petitioner.
“Petition for Oklahoma County Step 2”
In the first part of the petition, provide the full legal name of the minor, their age, date of birth, and the city and state in which they were born.
“Petition for Oklahoma County Step 3”
In part 2, the petitioner needs to provide the full legal name of the mother, along with her address. If the mother is deceased, the petitioner needs to write “deceased” and provide the proper documentation.

In part 3, the petitioner needs to provide the full legal name and current address of the father. Again, if the father is deceased, write the word “deceased” and provide a death certificate.

The petitioner needs to provide their relationship to the minor in part 4.
“Petition for Oklahoma County Step 6”
In part 6, the petitioner needs to provide their address along with their city, state, and zip code.
“Petition for Oklahoma County Step 7”
The petitioner cannot file for guardianship if they do not meet any of the factors on lines 6 through 6 through 8. The petitioner cannot be a convicted felon, have declared bankruptcy in the last 5 years, or be indebted to the minor.
“Petition for Oklahoma County Step 8”
On line 11, provide an approximate value of the minor’s assets.
“Petition for Oklahoma County Step 9”
Lines 12 and 13 require the petitioner to file the Oklahoma Sex Offenders Registration Act Affidavit as well as the Uniform Child Custody Jurisdiction and Enforcement Act Affidavit.

The petitioner must sign and date the bottom of the form and have the Petition notarized. After all of the forms are completed, the clerk will inform the petitioner of the time and date of the hearing.
