Form NV Packet 52 – Petition for Change of Name of a Family

INSTRUCTIONS: PETITION FOR CHANGE OF NAME OF A FAMILY NV Packet 52

 

A family should only use this form if they only want to change the last names of the family members.  The family members must be residents of the state for at least 6 months, and none of the family members can have a criminal record with a felony charge.  If any family member wants to change their first name, they will have to fill out a separate Petition.

This packet is intended for the change of up to two adult members and two minors.  If you do not want to change up to four names, write “N/A” in the appropriate places.

While filling out the forms you’ll want to regard pages 4 through 12 of the packet.  Following the instructions closely to make sure you’re filling out the forms correctly and keeping from passing over required forms.

After completing the necessary forms, you need to make 3 copies of the Petition and Notice of Petition.  Take these completed forms and copies to the Clerk’s Office and pay the filing fees.  You can pay by cash, money order, cashier’s check, or personal check.  Have the copies stamped.

If you need to ask the court to appoint you as the child’s guardian ad litem, regard pages 13-15 of the packet.

You need to publish the Notice of Petition in a local newspaper once a week for at least three consecutive weeks prior to the Summary Disposition or hearing.  If you feel your family is in danger with such publication, ask the court if you can waive the requirement.

If you want to request a Summary Disposition, regard pages 16-19 of the packet.  For information on the Prove-Up Hearing, regard pages 19-21 of the packet.

Form PC-NC-21.2A Name Change Packet (Minor)

INSTRUCTIONS: NAME CHANGE PACKET (Minor) PC-NC-21.2A

 

During the change of name for a minor, either the mother and father must consent or notice must be sent to a non-consenting parent by certified mail with a return receipt requested.  If the address of another parent is not known, the Affidavit provided in this packet needs completed and testimony under oath must specify what efforts were taken to locate the other parent.

In the Application, fill out the first two lines of the caption.  Then, check the appropriate box below the title of the document.  Only a parent, legal guardian, or guardian ad litem can complete the form.

Provide the county of the minor on the next line.  In the next section, check the boxes if the name and address of the parents are known and provide the necessary information.  If the address of the mother or father is unknown, check either box in the next section.  In the next set of lines, provide the minor’s current legal name, requested name, and reasons for change.  Sign the bottom of the document.

Complete the required information on the necessary forms and complete the captions.  Bring the forms and copies of the forms to the Probate Clerk’s Office and pay the filing fees.  You’ll want certified copies of the Judgment Entry, and you’ll need to pay $108.00 in cash for the filing fees.  Make sure to bring a certified copy of the minor’s birth certificate as well.

Publication of the name change is also required for a minor.  Notice is required in the Daily Reporter or the Columbus Dispatch for Franklin County applicants, and the fees range between the two newspapers.  The publication fees are the responsibility of the parent or guardian, and publication is required at least 30 days before the hearing.  The newspaper will provide an affidavit for proof of publication that needs submitted to the clerk’s office.

During the hearing, the judge will hear testimony from both the parents and the minor if they are of reasonable age.  If the judge agrees to the change, they will sign a Judgment Entry, and copies of this form are required for changing important records.

INSTRUCTIONS: VERIFIED PETITION NAME CHANGE CHILD UJS-030

This form is used in an uncontested name change for a minor.  You can change the first, middle, and/or last name of the child using this form. 

“Verified Petition Name Change Child UJS-030 Step 1”

In the caption, complete all lines except for the case number.  In paragraph 1 of the form, provide the first, middle, and last name of the petitioner.  Provide the minor child’s name in paragraph 2.  Enter the child’s date of birth including month, day and year in the 3rd paragraph.

Enter the child’s place of birth in paragraph 4 including city, county, and state.  Provide the petitioner’s relationship to the child in paragraph 5.  Provide each legal parent’s information in paragraph 6 including their last known address.  Provide the petitioner’s physical address in paragraph 7 including city and county.

Enter the county where the petitioner resides in paragraph 8 and how long they’ve resided in the county.  Provide the minor’s physical address in paragraph 9 and the duration of time they’ve lived there.

Provide the minor’s addresses over the last 5 years in paragraph 10.  If the child has only lived with parents, write “With the parents only” on the lines provided.  State whether there have been previous hearings concerning the child, and state whether another person has legal custody of the child besides the parents.

In paragraphs 11 and 12, provide the full names of the child’s mother and father as they appear on their birth certificates.  Write “N/A” if the father’s name does not appear on the birth certificate.  In paragraphs 13 and 14, provide the mother and father’s place of birth.

In paragraph 15, provide the child’s current name, requested name change, and reason for name change in the third line.  Sign the Petition and complete the Verification in front of the Clerk of Court.

INSTRUCTIONS: PETITION FOR NAME CHANGE MINOR

In order to change a minor’s name, the minor must live in the county where the petition is filed for at least a year.  The petition cannot be filed if the minor is currently involved in any type of lawsuit.

While filling out the Petition, you need to fill in all the blanks.  You should consult with an attorney for help with this form and all other forms.  Make copies of this form for all other legal parents and/or guardians.  You’ll also need to complete the cover sheet.

The petitioning parent needs to obtain consent from the other parent in order to file the Petition.  If consent is not obtained, the petitioning parent needs to send Notice of Hearing to the non-consenting parent.

Take the Petition, Cover Sheet, and Consent to Minor’s Name Change or Notice of Hearing on Petition to the District Clerk’s Office in the minor’s county.  Have the forms notarized.

Send notices to all interested parties.  If there is no response, a Summons and copy of the Petition needs sent to the party before the hearing.  If a return receipt is acquired by the petitioner, attach the document to the Proof of Service by Mail and file the forms with the court.  If a parent cannot serve another parent or interested party, ask the court to waive the service.

Attend the hearing.  The minor will probably have to testify, and other contesting parties are allowed to testify as well.  If the judge approves the name change, send notice to all required parties.

Return the signed Order Changing Minor’s Name to the clerk and ask for certified copies to change the minor’s birth certificate and other important documents.

If the change of name was denied, the petitioning parent can appeal the decision within 30 days of the hearing.  If the name change is granted, you will have to contact the Utah Office of Vital Records and Statistics to change the minor’s birth certificate.

INSTRUCTIONS: PETITION FOR NAME CHANGE (Individual)

This form is used for an adult attempting to change their name in King County, Washington.  If an adult is attempting to change a minor’s name, they need to use the Petition for Minor Child Name Change. 

“Petition for Name Change (Individual) Step 1”

Provide your full current name in the heading of the document.  Leave the case number blank.  In the second line, provide your current legal name again, including first, middle and last.

On the third line, provide your requested name change.  You can use this form to change your first, middle, or last name.

You need to check “Yes” in part 1 to use this petition.  If you check “Yes” in part 2, you need to provide notice to the King County Sheriff and the Washington State Patrol.  If you check “Yes” in part 3, you need to provide notice to the Depart of Corrections.

If you’ve changed your name prior to this current petition, you need to provide an explanation in part 4.

Provide specific reasons why you intend to change your name in part 5.

Provide the city where you’re submitting the petition at the bottom of the document.  Provide your signature and date of signature in front of the Court Clerk as well.  Write your street address and city, state, and zip below your signature as well.

After you complete the petition, you need to bring photo ID with you to the District Court division in the county you reside.  Make sure you’re prepared for the filing fees.  The minimum fee you’ll pay is $160.  This fee includes an $83 filing fee, $10 administrative fee, and a $62 recording cost for each person trying to change their name.

The case may be heard from the judge on the same day the petition is submitted.  If the judge approves the change of name, the petitioner will receive a certified copy in the mail.  Use this certified copy and any other additional copies to change important records like your birth certificate.
