INSTRUCTIONS: PETITION FOR APPOINTMENT OF GUARDIAN OF MINOR MPC140

This form along with all other required forms must be submitted to the Probate and Family Court in the division the minor currently resides in.

“Petition for Appointment of Guardian of Minor MPC140 Step 1”

After completing the heading of the form, parts 1, 2 and 3 are simple to fill out and require information about the minor and the petitioner.  The minor may choose to file a petition, or another interested party may file a petition.

In part 4, provide all necessary information for the legal parent’s of the minor.  If they are deceased, check the box on the right.

In part 5, state whether there is a willful nomination or other writing and attach a copy of the document if so.

In part 8, check all boxes that apply and provide the necessary explanations.  You may need the following forms and more for this part:

·  Notarize Consent of Parents

·  Court Order to this petition

·  Surrender to this petition

·  Death certificate for this Petition

“Petition for Appointment of Guardian of Minor MPC140 Step 5”

Make sure to check the box in part 9 and 10.  If the petitioner is not requesting to be guardian, the petitioner needs to provide all of required information for the Guardian in part 11.  If the guardian was nominated by the minor, the petitioner needs to attach the Nomination of Minor to this part.

In part 12, check all boxes that apply and provide any necessary information.  If the mother and father are deceased, provide information about other immediate family in part 13.  If there is another person acting as guardian or conservator for the minor in or outside of Massachusetts, the petitioner needs to complete part 14. 

“Petition for Appointment of Guardian of Minor MPC140 Step 7”

Part 15 lists any assets the minor may have in their name like bank accounts, property, anticipated income, social security, etc.

“Petition for Appointment of Guardian of Minor MPC140 Step 8”

The petitioner needs to sign the document and have their attorney sign the form as well.  The parents of the minor and those listed in parts 11-13 need notified.
