INSTRUCTIONS: PETITION FOR APPOINTMENT OF GUARDIAN/CONSERVATOR FOR MINOR 852

A guardian, limited guardian, or conservator needs to file this form along with Form 853.  This form and all attached forms need submitted to the Circuit Court Clerk in the county of the minor. 

“Petition for Appointment of Guardian/Conservator for Minor 852 Step 1”

On the first line of the document, provide the full legal name of the minor.  Provide the petitioner’s name on the second line and check the option below.  The petitioner can either choose guardian, limited guardian, or conservator.

In parts 1 and 2, provide the minor’s current address and the date of birth for the minor.  Write out the month’s name for the date of birth.

In part 3, provide a name and address of the minor’s spouse if appropriate.  If the minor is not married, leave this section blank.

If the minor’s parents are living, provide their names and addresses in part 4.  If one parent is living, write both parents name and the word “deceased” instead of an address for the parent.

If the parents are not living, provide the names and addresses for close family members such as siblings, grandparents, and aunts and uncles.

If a person or facility currently has custody of the minor, list the name and address in part 6.

In part 7, provide reasons why a guardian or conservator is needed.  If more room is needed, provide a separate sheet.

Part 8 provides a detailed description of the minor’s estate.  Write descriptions and estimates for real property, personal property, government benefits, insurance entitlement, yearly income, and other expenses.

In parts 9, 10, and 11, provide the petitioner’s address, the name and address of the petitioner’s attorney, and the name and address of the person seeking guardianship.  Then, check the appropriate box and make a signature before Notary Public.  The minor has a choice over the guardian if they are 14 or older.
