INSTRUCTIONS: MONTANA REVOCATION OF DECLARATION OF LIVING WILL

The form discussed in this article can be filed by a Montana resident who has previously filed a living will which contains instructions about withholding or withdrawing life-sustaining treatment in the event they are in a terminal condition which will result in their death in a short amount of time. This document can be obtained from the website maintained by the Montana Department of Public Health & Human Services.

Montana Revocation Of Declaration Of Living Will Step 1: A revocation can only be filed if you have previously created a living will, also known as an advance directive. Under the Montana Rights of the Terminally Ill Act, this can be done using a format provided by the state Department of Public Health & Human Services, but this is not legally required.

Montana Revocation Of Declaration Of Living Will Step 2: On the first blank line, enter your name. By doing so, you are declaring your intention of revoking a previously filed living will.

Montana Revocation Of Declaration Of Living Will Step 4: On the third blank line, enter the last two digits of the year in which you are filing.

Montana Revocation Of Declaration Of Living Will Step 5: On the fourth blank line, enter your signature.

Montana Revocation Of Declaration Of Living Will Step 6: Once you have completed the revocation, it must be communicated to your attending physician or any other health care provider by either you or by a witness to the revocation. The attending physician or other health care provider is required to make the revocation part of your record. Note that a revocation which is communicated to a person other than the attending physician, emergency medical services personnel or a health care provider is not effective unless the attending physician is informed of it prior to the moment when the qualified patient is in need of life-sustaining treatment.

Montana Revocation Of Declaration Of Living Will Step 7: In the event that you are unable to complete this written version of the revocation form, you may communicate the revocation orally. This is the case whether your living will was created in Montana or in another state.
