Form CCDR084 Petition for the Appointment of a Guardian of the Person

INSTRUCTIONS: PETITION FOR THE APPOINTMENT OF A GUARDIAN OF THE PERSON (CCDR084)

 

This form is used to establish or change guardianship for a disabled person.  The form needs submitted to the Circuit Court of the ward’s county. 

“Petition for the Appointment of a Guardian of the Person CCDR084 Step 1”

After filling out the information at the beginning of the form, the petitioner needs to provide the full legal name of the ward, sex, date of birth, age, and their current address in part 1. 

“Petition for the Appointment of a Guardian of the Person CCDR084 Step 2”

In part 2, the petitioner needs to list all people the disabled person is currently living with.  If the ward is currently living with the proposed guardian, address , and a name of another person who does not live with the disabled person is mandatory.

If the disabled person has an attorney, the petitioner needs to fill out part 3.  If there is no attorney, leave the section blank.

“Petition for the Appointment of a Guardian of the Person CCDR084 Step 4”

Part 4 provides the full legal name, date of birth, age, and address of the petitioner.  The last line of part 4 provides the petitioner’s relationship to the ward.

 The petitioner must list the name, address, and nature of interest for all other interested parties in part 5 according to Estates and Trust Article §13-101(j).

Parts 6 through 10 are fairly self-explanatory. Part 11 lists the property that the guardian wants to handle.  The petitioner can provide another sheet for more information.

Part 12 requires attachments of two certificates from physicians explaining the disability.  Parts 13 through 15 are self-explanatory as well.

Check all boxes that apply in part 16.  After a signature is placed and the Petition and all other required documents are filed with the Clerk of Court, a hearing will be set up as soon as possible.  The ward can provide their own testimony within the hearing.
