Form I-360 Petition for Amerasian, Widow(er), or Special Immgrant

INSTRUCTIONS : PETITION FOR AMERASIAN, WIDOW(ER) OR SPECIAL IMMIGRANT (Form I-360)


• The purpose of the Form I-360 is used to explicitly classify an alias as either an Amerasian, a widow or widower, a battered or abused spouse or child of a citizen of the United States or lawful permanent resident, a special immigrant, who is defined as one of the following individuals: A religious worker, an employee of the Panama Canal Company, a Canal Zone Government Employee, a United States Government in the Canal Zone Employee, a physician, an international organization employee or family member, a Juvenile Court Dependent, an Armed Forces Member, an Afghanistan or Iraq National who supported the United States Armed Forces as a translator or an Iraq national who worked for or on behalf of the United States Government in Iraq. Additionally, the individual may be classified if he or she is an Afghan national who worked for or on behalf of the United States Government in Afghanistan. 


• The Form I-360 consists of 12 pages; the instructions for the form are found on the 11th page of the application. You must note that the filing locations have recently changed for this particular petition; to understand your appropriate filing location please visit the United States Citizenship and Immigration services website for the most current guidance on where to submit your application. If you are filing at a lockbox, important filing tips, and additional information on fees and customer services will be listed on the agency’s website. The Filing fee for the Form I-360 is $405; this fee will not be applied to Amerasians, self-petitioning battered or abused spouses, parents or children of U.S. citizens or permanent residents. Special immigrant juveniles, Iraqi Nationals who worked for or on behalf of the United States Government in Iraq or Afghanistan.


• It is important to note that Religious Workers may not file Form I-360 with Form I-485 per the recent decision by the Ninth Circuit of Appeals, which overturned the permanent injunction issued by the District Court in Ruiz-Diaz v. The United States.

Form I-765 Application For Employment Authorization

INSTRUCTIONS: APPLICATION OF EMPLOYMENT AUTHORIZATION (Form I-765)

 

The I-765 form is for aliens currently in the United States to apply for an Employment Authorization Document (EAD), require a replacement of a lost EAD, or need for an expired EAD document to be renewed. This form is issued by the Department of Homeland Security and can be obtained from their website. It is processed by their US Citizenship and Immigration Services (USCIS) division.

 

Application of Employment Authorization I-765 Step 1: Check the appropriate box for whether you are seeking permission to accept employment and require an EAD, need a replacement for a lost EAD, or are requesting the renewal of an expired EAD. If the latter, attach the expired form.

 

Application of Employment Authorization I-765 Step 2: Write your full name. Below this, write any other names you have used.

 

Application of Employment Authorization I-765 Step 3: Write all information concerning your current American address.

 

Application of Employment Authorization I-765 Step 4: Write down your country of citizenship or birth.

 

Application of Employment Authorization I-765 Step 5: List your place and date of birth. Check the appropriate box to indicate if you are male or female, as well as the box describing whether you are married, widowed, divorced or single.

Application of Employment Authorization I-765 Step 7: If you have applied for an EAD, list the date of this application, the location of the office it was submitted to, and whether it was granted. Attach all documentation from that office concerning previous applications.

 

Application of Employment Authorization I-765 Step 8: List the date and place of your last entry into the United States. Indicate whether you entered as a worker, student or other type of alien.

Application of Employment Authorization I-765 Step 10: Consult the instructions issued by the DHS to determine your eligibility category. These are listed under the section headed "Who may file form I-765."  List the letter, arabic number, and roman numeral (the last only if applicable) describing your eligibility.

Form I-140 Petition for Alien Worker

INSTRUCTIONS: PETITION FOR ALIEN WORKERS (Form I-140)

 

Form I-140 is a form issued by the Department of Homeland Services (DHS). Employers must complete and submit this form in order to obtain a visa for any foreign citizen they wish to employ. The form can be obtained directly from the website of the Department of Homeland Services. A $580 submission fee must be included with the application.

 

Immigration Petition for Alien Worker I-140 Step 1: In Part I, enter your full name, address, the name of the business you are completing the form on behalf of and your IRS tax number.

 

Immigration Petition for Alien Worker I-140 Step 2: In Part II, check the box next to the line that describes the type of worker you are trying to bring over. Be sure to consult the instructions provided by the DHS for what kind of additional evidence must be attached to substantiate the status of the employee in question.

 

Immigration Petition for Alien Worker I-140 Step 3: In Part III, provide the name, address and contact information of the person you are filling the form out on behalf of, including their current nationality. If they are already in the United States, note their date of entry into the country, current status and information about their I-94 status. This is the visa that must be produced on arrival and departure in the United States.

 

Immigration Petition for Alien Worker I-140 Step 4: Indicate whether the worker in question will apply for visa at an embassy abroad or will be adjusting their status within the United States. Provide their foreign address if you have listed an American address previously. Note any other petitions being filed along with this one.

Form i-751 Petition to Remove Conditions On Residence

INSTRUCTIONS: PETITION TO REMOVE CONDITIONS ON RESIDENCE (Form I-751)

 

Aliens living in the United States on a conditional basis (those married to American citizens or children who entered the country with their parents) must apply to have these conditions removed before the second anniversary that they were granted this status. The US Citizen and Immigration Services (USCIS) office provides the Form I-751 form for this purpose. It can be obtained directly from their website.

 

Petition To Remove Conditions On Residence I-751 Step 1: List your name, address, mailing address (if applicable), alien residential number and the day your conditional residential status expires.

 

Petition To Remove Conditions On Residence I-751 Step 2: Indicate whether you are filing the petition jointly with your spouse or are a child who entered the country with alien parents. Other categories include those who were married but divorced, whose spouse is dead, who were abused by their spouse or parents, or who would suffer extreme hardship if removed from the United States.

 

Petition To Remove Conditions On Residence I-751 Step 3: Under "Additional Information About You," list the date and place of your marriage, as well as the date of your spouse's death (if applicable). Note any criminal charges filed against you or crimes committed in the United States or abroad. Consult official instructions to determine what kind of documentation must be attached. Those who are married to someone other than the spouse through whom they gained conditional resident status should note this here.


Petition To Remove Conditions On Residence I-751 Step 4: List the name, address, date of birth, social security number and alien residential number of the parent or spouse through whom you gained conditional residence.

 

Petition To Remove Conditions On Residence I-751 Step 5: List all children if applicable.

 

Petition To Remove Conditions On Residence I-751 Step 6: If requesting accommodation for yourself, a spouse or a child with disabilities, indicate this under "Part 6" and explain their condition.

 

Petition To Remove Conditions On Residence I-751 Step 7: Sign the document, along with the date. If you are filing jointly with a spouse, they should do the same.

 

Petition To Remove Conditions On Residence I-751 Step 8: If the document has been prepared by a lawyer, they should provide their name, contact information and the address of their firm below, along with a signature and date.

Form G-325 A Biographic Data Sheet

INSTRUCTIONS : BIOGRAPHIC INFORMATION (Form G-325a)


A G-325a Form is used by the U.S. Department of Homeland Security for the collection of biographical information for foreign nationals seeking entrance in the United States.  It is used in conjunction with the I-130 visa petition. 

In this case, we are using the G-325a Form provided by the Department of Homeland Security.   Examples of the form can be found online or directly from a Department of Homeland Security office..    

The first step in completing the form is to provide your basic information in the first few boxes.


1. Provide your name, gender, date of birth, and nationality in the first line of boxes. 


2. In the second line, put your alias names, city and country of birth, and your social security number, if one has been issued to you. 


3. The third line of boxes requires that you identify your mother and father, including their date, city, and country of birth, and their current residence. 


4. The fourth line requires you to identify your current spouse if any.  If you have a spouse, you must provide their name and information in the corresponding boxes.  


5. Name any former spouses and provide their information in the fifth line of boxes.


6. In the next box, you must document all of your past residences in the past 5 years.  Provide the address, city, state, country, and time of residence.  If you need additional space, you can use a supplemental sheet attached to your F-325a Form.


7. If you resided outside of the U.S. for more than a year, you must indicate the last address which you spent more than a year outside of the United States.  


8. In the next box, write down all of your previous employment for the past five years.  State your occupation, employer, and time spent in that position. 


9. Indicate what process you are supplementing with this G-325a Form, indicating naturalization, permanent resident status, or other.  Sign the completed form.


10.  At the end of the G-325a Form, provide your last name, first name, middle name, and alien registration number. 


11. Submit the form to supplement you I-130 Form and keep a copy for your records.
