I-485 Application to Register Permanent Residence or Adjust Status

INSTRUCTIONS : ADJUSTMENT OF STATUS/APPLICATION TO REGISTER PERMANENT RESIDENT (Form I-485)

• The Form I-485 Adjustment of Status is the Application to register for permanent status and is needed to adjust your status to that of a permanent resident of the United States of America. You may apply for the adjustment of status or permanent status if you an immigrant visa number is made immediately available to you based on a pre-approved immigration petition or if you are filing the application with a completed relative petition, special immigrant juvenile petition or special immigrant military petition.

• The Application consists of 6 pages and is filed at a location dependent on the eligibility category under which you are filing. Before beginning the application, you should review the “Direct Filing Addresses for Form I-485” link found at the United Citizenship and Immigration Service’s website for the most current guidance on where to submit your application. 

• The Filing Fee attached to the Form I-485 is $985; and additional $85 biometric fee, when applicable, will be placed on the initial filing charge bringing your total cost to bring your total to roughly $1070.

• Those applicants who are over the age of 79 will not be charged a biometric fee; additionally there is no fee for those applicants who are filing Form I-485 and maintain refugee status. For individuals under the age of 14, you must file the Form I-485 with at least one parent; the fee for children is $635. If you are a child under the age of 14 and do not file with a parent you will be charged the full $985.

• The I-485 Adjustment of Status form will first for initial evidence, pertaining to your criminal history, if applicable, your birth certificate and passport. Additionally, you will need to submit two identical color photographs of yourself taken within 30 days of filing the application. The photos must be 2X2’s, in color, with a full face frontal view on a white to off-white background. Additionally, when filing your Form I-485, you should also include your medical examination report with the application, unless you are a refugee.

Form I-539 Application to Extend Change Non Immigrant Status

APPLICATION TO EXTEND CHANGE NON IMMIGRANT STATUS (Form I-539)


An I-539 form is a document used by the U.S. Department of Homeland Security for an application for the extension or change in non-immigrant status.  The form is used to extend non-immigrant visas such as student, work, or visitor visas. 

In this case, we are using the I-539 form provided by the Department of Homeland Security.   Examples of the I-539 form can be found online or through a Department of Homeland Security office.    

The first step in completing the form is to list your personal information in the first section.


1. In part 1, provide your name, address, and country of birth, and any identifying numbers that you have used for applying for previous visas or immigrant papers. 


2. In part 2, indicate the application type you are applying for.  You can choose to extend, change, or reinstate your visa.  You must also indicate how many people are applying on this I-539 Form.


3. Part 3 requires that you further expand on your request.  Indicate how long of an extension you need, whether any other relatives have received an extension, and their contact information.


4. For Part 4, supply all information as it appears on your passport.


5. On page 2, read through each line and identify the answer that represents you situation.  Now check with the box below to determine if you will need to include additional information regarding your extension application.


6. Certify your form in part 5.  Indicate whether you understand English and have read and filled out the form or if you required an interpretor.  Sign and date on all appropriate lines.


7. Have an interpretor fill out part 6, if applicable. 


8. If another individual has prepared the form for the applicant, they must provide their certification in part 7. 


9. If more than one person is applying for an extension via your I-539 Form, you must include their information on the provided supplemental page.  If you need additional pages, attach them to the end of the form.  


10. Submit the form to the Department of Homeland Security and keep a copy for your records.

I-129 H1B Petition for a Nonimmigrant Worker

 

INSTRUCTIONS : PETITION FOR A NONIMMIGRANT WORKER (Form I-129)

(USE PAGES 1 through 7 ONLY)

A I-129 Form is used by the U.S. Department of Homeland Security for the petition of a non-immigrant worker visa. The form is required for any worker who does not intend to become a permanent resident to legally enter the United States

In this case, we are using the I-129 Form provided by the Department of Homeland Security.   Examples of the form can be found online or directly from a Department of Homeland Security office..    

The first step in completing the form is to provide the basic information of the employer.  

1. Put the employer's name in the proper boxes, followed by their address and contact number.

2. In part 2,  you must identify the purpose of the petition.  Include the non-immigrant classification of the worker, the basis for the classification, and the requested action that relates to your application. In line 5, indicate how many applicants your I-129 form will cover. 

3. In part 3, you must identify the individual or group you are sponsoring for the petition.  Indicate the person or group's name, birth dates, social security numbers, location of birth, and any other information that applies to the applicant.  Use the supplemental forms provided for each additional person the I-129 Form will cover.

4. Provide the processing information in part 4.  Select the offices that need to be informed of approval of the form.

5. In part 4 on the fourth page, indicate the passport and supplemental petitions being filed in conjunction with this form.  Select yes or no for each corresponding question.  Some questions may require you to write supplemental information on the extra forms that come with the I-129 form.  

6. Fill in part 5, stating the information of the employer and the nature of the employment.  You must include the type of business, the type of employment, the compensation that will be given to the employee, dates of the employment period, and any other information that relates to your situation. 

7. Part 6 requires the employer to certify they will comply with all technological data release regulations.  The employer must indicate whether a license from the U.S. Department of Commerce is needed for this type of employment. 

8. Page 6 requires signatures and certifications of the employer, as well as the preparer of the form if someone other than the employing entity filled it out.

Form DS-160 Online Nonimmigrant Visa Electronic Application

INSTRUCTIONS : ONLINE NONIMMIGRANT VISA ELECTRONIC APPLICATION (DS 160 Form)

NOTE: Must be completed through the U.S. Department of State Website

The DS 160 form, which is the application for a non-immigrant visa to travel to the United States, is available to complete at the United States Department of State website.  The form must be filled out online, following their instructions, and must be printed out and submitted.  

For this video, we will help guide you through the Department of State’s website.  
  
First you must access the Department of State’s DS 160 Form webpage.  Once you have accessed the page, you will be prompted to being filling out your DS 160 form.


1. You must first select the region of the world in which you will file your DS 160 form. 


2. You can also select your language in order to help you through the form in your native language.


Once selected, you must click the start application button at the bottom of the page.  


3. You will be prompted with a page in which you can test a visa photo, which you will need to submit online with your application.


4. You then must start a new application. 


After reaching this step, you will be given an application ID number, which you will need to record for further reference. 


5. You will need to select a security question in order to continue. 


On the next page, you will be required to provide your basic information, including name, address, and date of birth. 


You will next be prompted to give your passport information and your travel information.


6. If you are unsure of your exact travel plans, make sure to be as specific as possible in order to have your visa application complete.  Ensure that your visa will cover everything which you want to do on your visit.  


The next prompts will require you to give your work information, security information, and general background information. 


7. Ensure that your information is as accurate as possible, failure to disclose information will lead to denial of your visa.  


Next, you will need to upload a picture of yourself, following the instructions for your picture. 


Finally, you must print the completed application and submit it to the appropriate place as specified by the U.S. Department of State.

Chinese Visa Application Form


Chinese Visa Application Form

INSTRUCTIONS : CHINESE VISA APPLICATION FORM

A Chinese Visa Application Form is used by the Government of China for foreign nationals seeking entrance into the country.  Temporary visas are available for students, government officials, and business purposes. 

In this case, we are using the Chinese Visa Application Form provided by the government of China.   Examples of the Chinese Visa Application form can be found online or through the Chinese embassy.    

The first step in completing the form is to provide your general information in the first section.

1. Provide your name, sex, Chinese name, nationality, birthday, and passport information.  You must also indicate in box 1.14 your current occupation or status.

2. In section 2, you must indicate your reason for travel to China.  You must select the major purpose of your visit, the number of entries you will make, the date of entry, the counties and cities you plan to travel, and whether you need expedited visa service. 

3.  In section 3, you must include your health information and previous travel to other nations.  Check yes or no in the corresponding boxes to indicate your health status.  Any yes answer requires that you provide an explanation of your answer, which must be attached to your Chinese visa application form.

4. Provide your contact information in section 4.  Include your employer or school contact, your home address, and phone contact numbers.

5. Section 5 can be used for stating additional information that pertains to your visa application.  Leave blank if you do not have anything to write. 

6. If the application was filled out by another person than the applicant, that person must fill out section 6 with their name and contact information. 

7. At the end of the Chinese visa application form, the applicant must sign and date the form.

8. Submit the form to the local Chinese embassy and keep a copy for your records.
