INSTRUCTIONS: PETITION FOR EMANCIPATION OF A MINOR

 

§78A-6-801 through §78A-6-805 allow minor 16 years or older to ask the Juvenile Court for emancipation.  The following forms are needed to declare emancipation in Utah:

· Petition for Emancipation of a Minor

· Notice of Petition for Emancipation of a Minor

· Order on Petition for Emancipation of a Minor

· Declaration of Income and Expenses

· Order Appointing Guardian ad Litem

“Petition for Emancipation of a Minor Step 1”

In the heading, provide your full legal name, current address, and your main telephone number.  Provide the district number and the name of the county.  The Clerk of Court will provide the Juvenile No.

One the fourth line, provide the name of your school regardless of whether or not you’re currently attending school.  On the next line, list the date when you started living apart from your parents.

Line six requires you to attach your Declaration of Income and Expenses.  This documents shows that you have legal income and are capable of providing for yourself.

Line seven asks for you to explain why you want to become emancipated as well as why you believe you can live independently from your parents, guardian or custodian.  If you need more room, attach a separate document.

The next three lines ask for the legal names and addresses of your parents or guardian.  If you do not know the address of a parent, provides steps you have taken to contact the parent.

The next two lines ask for other people that are entitled to notice of the emancipation and their relationship to the petitioner.

The next two lines ask if you’re a dependent child or the probation ward of the juvenile court.  If you’re a ward, provide the name of the probationer officer on the next line and state whether you’re in state custody on the next line.

Sign and date the bottom of the form in front of Notary Public at the Juvenile Court.

INSTRUCTIONS: PETITION FOR THE EMANCIPATION OF A MINOR 

 

There is no statewide petition in the state of Indiana because all 21 judicial districts have their own form.  However, Southern Illinois University provides a generic version of the petition and other required forms that can be filled out and used in each circuit. 

“Petition for the Emancipation of a Minor Step 1”

Before filling out the Petition, you’ll need to gather the following forms as well:

· Entry of Appearance, Waiver, and Consent

· Notice of Hearing

· Order for Emancipation of a Minor

· Certificate of Mailing of Notice or Hearing

· Certificate of Mailing of Order

“Petition for the Emancipation of a Minor Step 2”

In the first paragraph, provide your full legal name and your age.

In the second paragraph, state whether you’re a resident of Illinois, own real estate in Illinois, or you have interest or are a party in a case in Illinois.  Only check one box.  If the first box applies, check that box.

In the third paragraph, check the box stating partial or complete.  If you check partial your parents will still have some rights over you. 

If you want to become emancipated, you need to explain why.  Are there housing barriers, education barriers, inabilities to enter into contracts because of your age, or more?  If you need more room, write “continued on a separate sheet” at the end of paragraph 3.

In the fourth paragraph, list the name and address of your parents if they are living.  If you have a guardian or custodian, list their name and address.

In the sixth paragraph, circle the option you choose in paragraph three for full or partial emancipation.  You’ll also need to state the amount of time you’ve lived apart from your parents.  Circle years, months, or days.

In paragraph seven, check the same option you chose in paragraph three and six.

Sign your name on both “Plaintiff” lines.  Print your name below each line.

“Emancipation Packet Step 1”

You need to qualify for emancipation in the first place.  There are three ways to get emancipated:

1. You have permission your parents and the court to get married.

2. You joined the military and have the approval of your parents.

3. Have the court approve a declaration of emancipation after meeting the following qualifications:

·  You are at least 17

·  You don’t live with your parents

·  Your parents approve of your moving out

·  You have a legal way to make your own money

·  Emancipation is in your best interest

The following numbers and descriptions correlate with the order they appear on the petition:

1. The county where you live

2. Your legal name

3. Your age

4. The case number that is assigned by the Circuit clerk’s office

5. Your legal name

6. The county where you live

7. Your parent’s names; if married both have to sign; if one or both parents are not involved your legal guardian must sign; if parents have joint legal custody both must sign; if deceased write “None”

8. Your signature and address

11. Sign your name and the notary public will fill out the rest

19. Name and signature of parents and the notary will fill out the rest (two copies are needed if both parents have joint legal custody)

The judge will complete the rest of the order.  You will need to bring a money order for court filing fees which are currently $140.00 as of 2012.  Ask for the phone number of the judge’s case coordinator.  Once the emancipation is granted, ask for a copy from the Circuit Clerk’s office.

Form 125 Emancipation Petition

INSTRUCTIONS: EMANCIPATION PETITION (Form 125)

 

In order to qualify for emancipation, a minor has to meet all requirements under 12 V.S.A §7151(b).  The minor must be a resident of Vermont for at least three months before filing.

The Clerk of Court will fill out the header of the petition.  In the next two lines, write your name and your parent’s names or your guardian’s name.

In the first paragraph, write your full legal name, your full date of birth, and the county or state where you were born.

In the second paragraph, write your full current address.  If your mailing address is different, list both.  You’ll also have to list your main telephone number.

In the third paragraph, list the full legal names, addresses and telephone numbers of your parents.  If their address is unknown, you must attach a separate sheet explaining all steps you’ve taken to locate them.

If your parents do not have legal custody, fill in paragraph five and list the name, address, and telephone number of your guardian.

In the sixth paragraph, list all criteria under 12 V.S.A. §7151(b).  You’ll have to attach a separate sheet explaining the criteria, and you’ll have to attach another sheet explaining your ability to become self-sufficient.

Consider attaching a statement from your employer stating your level of maturity and your rate of pay.

Paragraph seven is your own personal statement concerning why emancipation is in your best interests and the reasons why you’re seeking emancipation.  If you need more room, place the words “see attached” at the bottom of the paragraph and attach a separate form.

Sign and date the bottom of the form in front of Notary Public, the Judge, or the Register.  They will complete the rest of the petition.
