“Emancipation Packet Step 1”

You need to qualify for emancipation in the first place.  There are three ways to get emancipated:

1. You have permission your parents and the court to get married.

2. You joined the military and have the approval of your parents.

3. Have the court approve a declaration of emancipation after meeting the following qualifications:

·  You are at least 17

·  You don’t live with your parents

·  Your parents approve of your moving out

·  You have a legal way to make your own money

·  Emancipation is in your best interest

The following numbers and descriptions correlate with the order they appear on the petition:

1. The county where you live

2. Your legal name

3. Your age

4. The case number that is assigned by the Circuit clerk’s office

5. Your legal name

6. The county where you live

7. Your parent’s names; if married both have to sign; if one or both parents are not involved your legal guardian must sign; if parents have joint legal custody both must sign; if deceased write “None”

8. Your signature and address

11. Sign your name and the notary public will fill out the rest

The judge will complete the rest of the order.  You will need to bring a money order for court filing fees which are currently $140.00 as of 2012.  Ask for the phone number of the judge’s case coordinator.  Once the emancipation is granted, ask for a copy from the Circuit Clerk’s office.

Form 125 Emancipation Petition

INSTRUCTIONS: EMANCIPATION PETITION (Form 125)

 

In order to qualify for emancipation, a minor has to meet all requirements under 12 V.S.A §7151(b).  The minor must be a resident of Vermont for at least three months before filing.

The Clerk of Court will fill out the header of the petition.  In the next two lines, write your name and your parent’s names or your guardian’s name.

In the first paragraph, write your full legal name, your full date of birth, and the county or state where you were born.

In the second paragraph, write your full current address.  If your mailing address is different, list both.  You’ll also have to list your main telephone number.

In the third paragraph, list the full legal names, addresses and telephone numbers of your parents.  If their address is unknown, you must attach a separate sheet explaining all steps you’ve taken to locate them.

If your parents do not have legal custody, fill in paragraph five and list the name, address, and telephone number of your guardian.

In the sixth paragraph, list all criteria under 12 V.S.A. §7151(b).  You’ll have to attach a separate sheet explaining the criteria, and you’ll have to attach another sheet explaining your ability to become self-sufficient.

Consider attaching a statement from your employer stating your level of maturity and your rate of pay.

Paragraph seven is your own personal statement concerning why emancipation is in your best interests and the reasons why you’re seeking emancipation.  If you need more room, place the words “see attached” at the bottom of the paragraph and attach a separate form.

Sign and date the bottom of the form in front of Notary Public, the Judge, or the Register.  They will complete the rest of the petition.

INSTRUCTIONS: PETITION FOR DECLARATION OF EMANCIPATION OF MINOR (MC-300) 

 

“Petition for Declaration of Emancipation of Minor MC-300 Step 1”

Fill out all information the petition asks for, and make sure you sign the petition and write the date.  You’ll have to attach the following forms to the petition as well:

· Emancipation of Minor Income and Expense Declaration MC-306

· Notice of Hearing — Emancipation of Minor MC-305

· Declaration of Emancipation of Minor After Hearing MC-310

Write a statement to the court explaining the following:

· How you live

· Why you’re seeking emancipation

· How you support yourself

· How you support your children if you have any

If you have parents, tell the court when you last saw them.  If you don’t want to tell your parents about the petition, explain to the court why.

Have your paperwork reviewed by the family law facilitator or the self-help center to make sure you filled out the paperwork correctly.

Make copies of your forms and statements and ask the court clerk how many copies you need for each form.  Ask the clerk how the court handles your specific emancipation.

Ask your clerk if you need a hearing or not.  Some counties require a hearing in all cases, and other counties only require a hearing if the parent do not agree to the emancipation.

You’ll most likely have to give notice to your parents or guardian.  You need someone 18 or older to serve form MC-305 to the parent or guardian and then fill out Proof of Service POS-040.

Before the court hearing, fill out Declaration of Emancipation of Minor After Hearing MC-310.  Fill out the top of the form and the judge will fill out the rest.

If the judge approves the emancipation, take the forms back to the clerk and get certified copies.

Form EM01-010 Petition for Emancipation

INSTRUCTIONS: PETITION FOR EMANCIPATION (PTE) (WPF EM 01.0100)

 

According to RCW 13.64.010, any minor who is 16 years or older and a resident of the state may file with the superior court for emancipation.  All procedures for emancipation are listed with Chapter 13.64. 

While filing for emancipation, you’ll need the following forms:

· WPF EM 01.0100 Petition for Emancipation (PTE)

· WPF EM 01.0200 Notice of Hearing (NTHG)

· WPF EM 01.0300 Order Appointing Guardian Ad Litem (ORAPGL)

· WPF EM 01.0400 Decree of Emancipation (DCE)

· WPF EM 01.0500 Order Denying Petition for Emancipation (ORDYMT)

“Petition for Emancipation (PTE) WPF EM 01.0100 Step 1”

In the heading of the petition, list your name and your date of birth.  The Clerk of Court will fill in the rest.

In paragraph 1.1, provide your full legal name, your current address, the date you moved into the address, your full date of birth, and the state and county of your birth. 

You’ll also have to attach a certified copy of your birth certificate.  The certified copy cannot be a photocopy.

In paragraph 1.3, you need to list the full legal name of your parents, legal guardian, or your legal custodian.  You also need to list the last known address of your parents, guardian, or custodian.  If your parents live apart from each other, list both addresses.

In paragraph 1.4, you need to provide evidence that you can manage your own financial affairs.  You should consider attaching a statement from your employer.

Paragraph 1.5 states that you’re mature enough to live on your own and manage your personal, social, education, and nonfinancial affairs.  Consider attaching documentation from good-standing community members such as teachers, counselors, etc.

Paragraph 1.6 lets you provide any further evidence that may convince the court to grant emancipation.

At the bottom of the form, sign and print your name in both locations.  Be aware that there will be filing fees.  You also need to provide your parents or guardian with notification and copies.
