INSTRUCTIONS: PETITION FOR EMANCIPATION OF A MINOR
§78A-6-801 through §78A-6-805 allow minor 16 years or older to ask the Juvenile Court for emancipation. The following forms are needed to declare emancipation in Utah:
· Petition for Emancipation of a Minor
· Notice of Petition for Emancipation of a Minor
· Order on Petition for Emancipation of a Minor
· Declaration of Income and Expenses
· Order Appointing Guardian ad Litem

“Petition for Emancipation of a Minor Step 1”
In the heading, provide your full legal name, current address, and your main telephone number. Provide the district number and the name of the county. The Clerk of Court will provide the Juvenile No.
“Petition for Emancipation of a Minor Step 2”
One the fourth line, provide the name of your school regardless of whether or not you’re currently attending school. On the next line, list the date when you started living apart from your parents.
“Petition for Emancipation of a Minor Step 3”
Line six requires you to attach your Declaration of Income and Expenses. This documents shows that you have legal income and are capable of providing for yourself.
“Petition for Emancipation of a Minor Step 4”
Line seven asks for you to explain why you want to become emancipated as well as why you believe you can live independently from your parents, guardian or custodian. If you need more room, attach a separate document.
“Petition for Emancipation of a Minor Step 5”
The next three lines ask for the legal names and addresses of your parents or guardian. If you do not know the address of a parent, provides steps you have taken to contact the parent.
“Petition for Emancipation of a Minor Step 6”
The next two lines ask for other people that are entitled to notice of the emancipation and their relationship to the petitioner.

The next two lines ask if you’re a dependent child or the probation ward of the juvenile court. If you’re a ward, provide the name of the probationer officer on the next line and state whether you’re in state custody on the next line.
“Petition for Emancipation of a Minor Step 8”
Sign and date the bottom of the form in front of Notary Public at the Juvenile Court.
