Entry Authorizing Sale of Personal Property

 

INSTRUCTIONS: OHIO ENTRY AUTHORIZING SALE OF PERSONAL PROPERTY (Form 9.1)

 

 

The form discussed in this article is completed by probate judges in Ohio to authorize the sale of personal property from an estate by an administering fiduciary. To obtain permission, the fiduciary is required to file form 9.0, which contains the application for this this authorization. Both documents can be obtained from the website maintained by the Ohio Supreme Court.

 

Ohio Entry Authorizing Sale Of Personal Property 9.1 Step 1: On the first blank line, enter the  name of the county in which the probate court is located.

 

Ohio Entry Authorizing Sale Of Personal Property 9.1 Step 2: On the second blank line, enter the name of the decedent whose estate is being probated.

 

Ohio Entry Authorizing Sale Of Personal Property 9.1 Step 3: On the third blank line, enter the assigned case number.

 

Ohio Entry Authorizing Sale Of Personal Property 9.1 Step 4: The probate judge will check the first statement if they have found that the fiduciary is authorized to sell the personal property in question in accordance with the terms and conditions set forth in the application.

 

Ohio Entry Authorizing Sale Of Personal Property 9.1 Step 5: The probate judge will check the second statement if they authorize the fiduciary to sell the personal property in question in accordance with the terms and conditions set forth in the application except with exceptions or limitations which will be detailed by the judge on the blank lines provided.

 

Ohio Entry Authorizing Sale Of Personal Property 9.1 Step 6: The probate judge will check the third statement if the time has not expired within which the surviving spouse may elect to purchase personal property at its appraised value, the surviving spouse has not consented to the sale, and the property is not perishable. If this is the case, the fiduciary is required to serve at least ten days notice of the sale upon the surviving spouse.

 

Ohio Entry Authorizing Sale Of Personal Property 9.1 Step 7: On the next blank line, the probate judge will enter the date.

 

Ohio Entry Authorizing Sale Of Personal Property 9.1 Step 8: On the last blank line, the probate judge will enter their signature.
